When you have been directly caring for a patient* or observing patient* care, what experiences were relevant from a legal point of view? Develop a de-identifed case study and include this as an appendix. Consider your case from a healthcare relationship perspective and critically analyse your practice and/or observed practice in relation to the key topics of;

  • Consent, informed refusal and autonomy
  • Trespass and false imprisonment
  • Negligence
  • Duty of care
  • Standard of care
  • Confidentiality and privacy

Please note: not all of the legal concepts above may be relevant to your case, you will need to analyse your case and consider which of the concepts above are relevant to discuss.

* When I have been directly caring for a patient and or observing a patient care, the experiences are relevant from a legal point of view, includes,

1. Standards of care : the quality of care is essential in the Australian people. So standards of care is one of the legal point, if there is no quality in care, then it must be a legally complicated.

2. Consent, informed refusal and autonomy : before providing any care to the client and before doing any procedures to the clients, there must be need consent to take to prevent legal complications.

And self respect also should be given to the client, that means some times accept patient suggestions also.

3. Confidentiality and privacy : what ever the patient related information and and problems should be maintained confidentially, should not reveal to all the persons who are not authorized.

4. Negligence : should not be there while providing care to the clients.
