Identify who can bring a lawsuit and against what defendants and based on what law and applied facts. Briefly explain whether the case is strong or weak. When finding ‘torts’ (chapter 6) be sure to name the tort, provide a brief definition, and apply to the relevant facts indicating again, the identity of the defendant. You may make a list of the lawsuits (number them if you want to do so), setting out the identity of the plaintiff, the law or laws probably broken, and the defendant/defendants always referring as well to ‘key’ facts (as noted above). When applying the law, be sure to write sentences: clarify your reasoning, which should evidence close attention to the book.

Problem:

Darwin is the President of Event Company. Alice works for Event Company, which provides set up, service, and catering for big events (weddings, concerts and so forth) and for corporate events.

Darwin is worried about competition because Event Company is not attracting as many corporate clients as competitors. One day, Darwin sets up a presentation designed for five corporate CEOs to introduce them to Event Company’s services. The presentation is set for a Tuesday afternoon, for three hours, from one to four. However, three of the CEOs, including Sharon from ABC Company, want to leave during the break at 2 pm, but Darwin has considered this possibility, so he tells them he has just been informed that the parking gate has been locked and it will take an hour to fix. (This is a lie.) The CEOs are annoyed but stay for the remainder of the presentation. At the end of the presentation only Dennis, one of the five CEOs, shows an interest in Event Company’s services.

Darwin is even more worried, so he calls in his Marketing Specialists for a meeting and tells them that each will earn a $15,000 bonus if they bring in three ‘new’ clients. Darwin says, “Do whatever you have to do to beat the competition. All’s fair in love and war and business: that’s our law just don’t get caught After all, we have a reputation for being an upstanding company. What people don’t know can’t hurt us.”

Alice is a Marketing Specialist. She works on marketing and finding clients as well as making sure current clients do not go to competitors. Most of these clients are very wealthy and live in homes behind large gates and security cameras. When Event Company and its competitors see announcements or news items on social media concerning wedding announcements, big birthday, graduation and other celebrations, they make a list of the potential clients and send out employees hoping to generate interest in services. One competitor, Big Bash Company, seems to have its own ‘secret’ list of potential clients and often is hired to hold events for clients who are very private. Alice would love to get hold of their client list and earn the bonus. Alice decides to follow Chet Markum, the marketing specialist for Big Bash, a competitor, one Monday morning, hoping to identify clients on the ‘secret list’. When Chet stops at the gates to the huge mansion of Marlene Canaday, and gets access after announcing himself at the ‘gate,’ Alice parks nearby. Alice climbs over the wall without announcing herself, and sneaks up to the front door only to see a security guard coming around the side of the house. Alice is near a new BMW, goes for the door, finds it opens and hides inside. Alice hears the security guard say, ‘Mr. Markum, I will walk you to the gate.” Gleefully, Alice exits the car. She goes up to the front door, and when Marlene answers the door, tells Marlene that she works for Event Company and they will charge 30% less for any event management than whatever Big Bash offered. Alice adds, “Big Bash is now being investigated for fraud by the State Department of Banking, not that Big Bash is guilty. It’s just an investigation but you should know that” (Alice knows full well that Big Bash is not being investigated for fraud.) Marlene is interested, lets Alice in and ultimately signs a contract for a birthday event at a nearby Winery. Alice continues to follow Chet for the next two weeks and ends up finding 5 new clients, always sneaking onto the property, and approaching the clients after Chet has left.   Two of the clients actually had made contracts with Chet and told Alice, but she reminded these two clients about the ‘fraud investigation’ , so those clients decided to ‘cancel’ their contracts and sign a new one with Event Company.

A month later, Big Bash learns from the potential clients who cancelled their contracts that they had been informed about a fraud investigation by Alice from Event Company, who saw them the same day that Chet came. Big Bash later learns that other clients, who had told Chet they were interested in Big Bash, lost interest after a visit from Alice.

Also, Sharon, one of the CEOs who had attended the Tuesday, 1-4meeting and had wanted to leave during the break, finds out, from a social media post, that Events Company had lied about the broken parking gate in order to keep some corporate leaders at a meeting. The post came from an Events Company employee, Bruce, who had just been fired for reporting to the State Department of Fair and Equal Employment that Event Company had failed to offer, for the past two years, an annual two-hour training on sexual harassment required by state law.

A case involving the unlawful attempt to bribe consumers of ' Big Bash Business ' to steal customers, and diffamation is involved in the loss of the image of the company owned by Darwin and by Alice, publicity specialist.

In the start, Alice was breaking the law because she was trailing ChET Markum (the Big Bash company's and its Competition Promotion Specialist) to locate the list of prospective and confidential clients. Alice snails and tricks ChET for the purpose of stealing the clients from ChET. She robbed some customers, but later caught Big Bash when the customers who withdrawn their contract were told about this illegal act by the agency, and signed it with Darwin.

I can therefore conclude after reviewing the whole legal case that these four rules, which are listed below, have been broken:

a.Stealing potential competitors and secret customers from businesses.

b.For her own business purpose, sneaking and spying a person (stranger).

c.Spreading false information to the respective customers and lying about a company.

d.Brand Image Degradation of Company Competitor.
