There are various sources of Law in the United States. There are
three branches of government – legislative, judicial, and
executive. All these function have a unique role to play in
relation to the law. The legislative branch is responsible for
making the law. The judicial branch is responsible for interpreting
the law. The executive branch enforces the law. Various laws are
drawn from various sources. These sources are constitutions,
statutes, executive orders, administrative agencies, common, law
and law of equity.
Constitutions:
It is the most important source of law in the United States.
Constitution acts as the foundation to the government. This makes
it very important. The role of constitution is very critical. It
specifies which organizations have what powers, limits of the
government and the rights of the citizens.
Statutes:
The public elected representatives have the right to pass the
Statutes. Public elected representative form state legislatures and
the U.S. Congress. These help public by serving them as guidance,
which makes them think before they act. They are aimed at
addressing the potential social needs and problems. Therefore,
Statutes cover broad range of issues which makes them applicable to
a variety of circumstances.
Executive orders:
This is a part of executive branch. Under this branch, Mayors,
governors, and presidents issue executive orders. These orders are
bounded by law. Sometimes, executive orders are passed in order to
fill in the details of legislations passed. Sometimes they are
passed to encourage their own policies.
Administrative agencies
These are part of the executive branch and carry out the mandates
of the legislative branch in specific government- regulated
industries.
Federal departments:
They also make administrative rules. But, they cannot act
independently of the executive branch. The heads of these
departments are appointed by the president. They are also made part
of the president’s cabinet.
Common Law and Law of Equity:
Common law is also known as the case law. Common law is based on
the various judgements passed in many cases. Judges create common
law when no statutory law covers the issue at hand. Later, in
future similar circumstances, judges rely on these judgements they
passed.
