An administrative agency such as FDA can make substantive, procedural or legislative rule.

The FDA in this case created a legislative rule as it created guidelines to make sure that the access to cigarettes for adolescents and children was curbed. Since it was a broad ruling, it was a legislative rule. If it was a procedural rule, it would've related to the process of making, marketing and selling the product. If it was a substantive rule, it woulve related to the substance in the product.
