The elements that are required to prove criminal assault are:-
1.An act or conduct intended to create. In order to prove criminal assault, the defendants behaviour must be motivates to intend sense of fear or danger in victim, accidental behaviour is not counted as assault.
2. A reasonable apprehension. The victim must believe that the defendants act is harmful and dangerous, it is very important for the victim to perceive defendants behaviour or action as harmful.
3. Of imminent harm. The victims fear should be a direct response to threat that is immediate and about to occur. The threat should not be in a delaying manner.
4. That is considered either harmful or offensive. The defendants actions must present a physical harm or dangerous behaviour like Kicking or punching the victim or spitting on victim.
These elements should be present with the evidence in order to prove criminal assault.
