If the employers believe that they have been issued a citation unfairly from OSHA, they must submit a Notice of Intent to Contest in writing to the OSHA area office within 15 working days from the date of receiving the citation. Before filing the notice of intent to contest, the employer may request for an informal conference with the OSHA area director to discuss the citation. But the procedure to contest the citation applies even if they have stated their disagreement during an informal conference. The Notice of Intent to Contest must state what is being contested and the contest must be made in good faith. The OSHA area director forwards the case to the OSHRC when the employer files the Notice of Intent to Contest.
