A. Juan should describe to jean about the legal stance concerning software copyright that there are two Pre - requisites before filing first is Original and second is Tangible with another medium.You have to be able to prove that the source code that you have is not a part of a existing source code either in the form of licence,copy or picked up from any internet source or it is not part of open source software as well.A requirement is not very strict and complex,as per Indian law,it is not necessary to register with the copyright office to get copyright protection.As India is a signatory of Berne Convention for protection of literacy and artistic works,copyright of any work in the member countries is protected in all the signatory countries.Copyright protection is automatic from the moment the work is embodied in some medium like CDROM , magnetic tape,diskette or paper.

B. Juan should explain to Jean that computer software can be classified into two types first one is Application software and second one is System software.System software is a set of instructions needed for a computer to work .System software helps run the computer hardware such as CPU,mouse,printer etc.Application software are used by users to run specific application according to their need for example we use computer to develop animation,weather forecast,digital mixing etc.

Copyright consideration of system software and application software are -:software copyright in a computer program is not only infringed by taking a direct copy of the code (source code or compiled code) but also by versions of the program re-written or otherwise converted into another computer language, these being considered infringing ""adaptations"" of the original work.  When you run a program on a computer there is normally some copying of the program within your computer’s memory, so a copyright licence is needed: this is why when you buy computer software you are effectively buying a copyright licence to use the software and must use the software in accordance with the terms of the licence.

C. Juan should provide to Jean about the software piracy that the computer software or simply software is any set of machine-readable instructions that direct a computer's processor to perform specific operation .Here piracy refers to the unauthorized duplication of copyrighted content that is then sold of substantially lower prices in the 'grey' market.Software piracy is the illegal copying,distribution,or use of software.

Software piracy is stealing. If you or your company are caught copying and/or distributing illegal copies of software, you could be held liable under both civil and criminal laws. If the software owner decides to sue you or your company, the owner can seek to stop you from using/distributing its software immediately and can also request monetary damages.

  • No warranties
  • Lack of technical support
  • Ineligibility for software upgrades offered to properly licensed users
