Discuss whether corporate investigations are easier to conduct than law enforcement investigations. What legislation should be considered in both investigations?
In my opinion, both kinds of investigations i.e. corporate and law enforcement investigations, hold equal level of toughness and therefore in my opinion ,the level of easiness cannot be compared between the two.
This is because, in corporate investigations a thorough investigation of a corporation or business is done in order to uncover wrongdoing committed by management, employees, or third parties whereas in law enforcement investigation, the investigators determine the motives, suspects, victims and methods involved in a crime by collecting and analyzing evidence, talking to witnesses and observing suspicious activities.
Therefore,it is evident from the functioning structure of both the investigatory procedures that both types of investigations are from different domain but requires same approach and the techniques which are followed for investigations are similar.
The legislations which should be considered in both of these investigations should be to first understand the whole issue in a correct and detailed manner. Then listing out the entities involved and might be involved and the performing a thorough investigation over the matter involving the concerned entities.
