Deterrence is the main philosophy of punishment in the US justice system as this is based on the argument that deterrence, rather than retribution, is the prime justification for punishment a hallmark of the rational choice theory can be traced to Cesare Beccaria, whose well-known treatise On Crimes and Punishments (1764) have very effectively condemned torture and the death penalty. Thus since death, plenty is practiced in the USA and the main justification given for it is deterrence it can be concluded that deterrence is the main philosophy of punishment in the US justice system. Based on three individual components: severity, certainty, and celebrity it can be concluded that the more severe a punishment, it is thought, the more likely that a rationally calculating human being will be deterred from criminal acts.
