A taxpayer may be treated as actively participating in a rental real estate activity when they own at least 10% of the property and :Make Management decisions in a significant and bona fide sense.

Because Active participation as a rental activity in which a taxpayer participates by making "management decisions" or arranging for others to provide services. Management decisions that may count as active participation include approving new tenants, deciding on rental terms, approving capital or repair expenditures, and other similar decisions. and as per section 469(I)(6) does require that an individual own at least 10%(by value) of all interests in any rental real estate activity in order to be treated as actively participating in the rental real estate.
