HIPAA Violations

HIPPA Violation or breach is a serious offense which may cause a huge penalty. All health care providers and organizations should be aware of the legal consequences in the breach of the protected patient informations. There is a responsibility to safeguard the personal information of the clients. The probability of violation increases with the number of physical transport or electronic transmission of data from one institution to another.

Mitigate the Risks

The important steps to mitigate the violation risks include;

1. Create a checklist for best practices and policies. These checklists will help to minimise the accidental HIPAA violations. It will provide a road-map of remedial actions to solve the problems, if anything happens. Checklist will also increase the compliance of health care providers to adhere with the policies. Creating a HIPAA checklist for staff will help to mitigate the risks of violations. Checklist should include all medical informations storage rules.

2. Orientation programmes and training of newly hired staff should include HIPPA risk mitigation informations so that there will not be any breach unknowingly.

3. Control should be implemented on the access of confidential informations. Unauthorized access should be restricted. Access to medical records as well as electronic data should be given to only authorized personnel.

4. Create policies which include all possible contingencies to address breaches of security. Immediate actions should be taken for any violations.

5. Prepare written policies for the physical transportation of medical records and electronic transmission of protected patient informations.

6. Make certain that other doctor offices or health care institutions also having strict HIPPA compliance, before transfering informations and establish strict control over their activities with the transferred data.

7. Create a Risk Assessment Tool to identify the areas where weaknesses and vulnerabilities may exist for violations. HIPPA Risk Assessment should be done periodically to find out any new risks. Risk assessment should be done whenever a new work practice or technology is introduced in the institution.

8. Make sure that the security systems in the computers are effective and updated for the storage of electronic data. Since the hackers are constantly inventing new malwares to penetrate networks, repeat the risk assessment process on a regular basis.
