Every patient has the right to maintain confidentiality of their own health information. So the provider has to obtain consent from the patient before disclosing the patient's information to the family members. The provider can share patient's information to the family members in case of children who are under 18 years of age, a family member has a waiver of obtaining health information, or if the patient is unconscious and unable to take the decision. If the provider has shared information without the patient permission, then the patient can take action with the help of an attorney.
