As the manager of a community hospital's Emergency Department, you have been tasked with developing a policy to prevent patients from receiving ED services for non-emergent conditions. Prepare a policy draft to be reviewed by the hospital's leadership team. This team includes legal counsel, physicians and registered nurses, as well as chief operating, financial, and executive officers. Your wording should be professional, and consistent with an organization's policy (do not include statements that indicate opinion, personal views, or observations).

  • In an opening paragraph, summarize EMTALA and the hospital's obligation to comply with it.
  • In a second paragraph, explain the need for and reasoning behind the policy.
  • In approximately 1 page, draft the policy to provide guidelines for all staff, including clinical providers when triaging patients who walk into the ED.
  • On a separate page, include a "Question & Answer" section. Provide six questions (and answers) that the leadership team is likely to ask after reading your policy draft.

EMTALA is to confirm the patient transfer to emergency department and to confirm uninsured patient were transferred.mainly for financial reasons,Moreover,transferring of patients from private to public hospital without taking consideration of their condition or stability for the transfer.The patient has given written informed consent for their transfer.And EMTALA tells that if anyone comes to the emergency department and a request is given to get examined or treated according to their medical condition,the organization must give facility to check all investigations with in the capability of emergency department.

if the hospital fails to complete EMTALA or if any in appropriate actions take place ,that is violating the law.the organization get punished if they break the rules.they will be asked for penalties and inspection will be done under IG of department of health and human services..fines can increase morthan fifty thousand dollars per patient.Thus,hospital has the responsibility to follow EMTALA to prevent it get violated.it is also comes under medical negligence and malpractice which is a serious offense.

EMTALA is necessary in Medicare participating hospitals to identify the patients for their medical condition and provide better treatment Fcilities.In this hospitals are required by law to or services regardless of their economic stability.Thus ,patients will feel equality and comfortable this will help for speedy recovery..Transfering of the patient also should be appropriate to provide quality care.Thus,this policy is necessary for hospitals to keep better health of their patients.

Priority 1:it is CODE RED.it means patients should get emergency care there will not be any delay.eg.patient with ectopic pregnancy,cardiac arrest and shock

Priority 2-CODE YELLOW.this patients should get immediate treatment but can delay treatment at least 1 to 2 hrs.

eg.acute appendicitis,fracture

Priority 3-CODE GREEN-this Priority consists of stable patients.patients who have fever,vomiting etc.

Priority 4-CODE BLACK-in this catagorie includes death patients or patients who is going to be die..
