Answer: No, the driver is acting for the passenger, but not under his control. Hence he cannot be called as an agent of the passenger.

An agent is someone who act under the control of the principle for a consideration and for certain terms and conditions.

In the given case the driver is acting upon his will to detour the passenger with or without consideration, but not with a definite control exercised by the passenger.
