Animals are considered “property” under the law in United States of America. This means that in many cases, you are limited to compensation for your animal’s “market value,” along with associated economic damages like veterinary bills.
In recognition of animals’ elevated places in our homes and lives, a growing number of states now also allow greater awards than economic damages. In the states including Tennessee, Illinois and New York, one may also be able to receive noneconomic and punitive damages in some cases, such as if the person who harmed your animal did so on purpose.
Additionally, talk about whether other damages should be available in light of the place that pets hold in our families.
Apart from the above stated damages, other damages should also be available in light of the place that pets hold in our families. These damages could range from emotional distress that the pet injury or killing has caused to the punishment related to the tort to the animals.
Also, look at trends across the country in this area and how recent cases have dealt with such damage claims.
One of such case is John and Evelyn Nichols v. Sukaro Kennels where during a stay at defendant kennel, the kennel owner's pet tore off plaintiff's pet’s left front leg and shoulder blade. Plaintiff's petition sought damages to compensate for the injuries and suffering the pet incurred and the loss of aesthetic intrinsic value of the pet. In upholding the district court's denial of damages for emotional injury and mental suffering, the Court of Appeals rejected plaintiff's argument for damages based on the intrinsic value of a pet for the negligent injury to the pet.
What is your opinion of what should be recoverable and why?
When an individual causes an injury to the pet, all the bills of the medication being provided to the pet should be recovered from the individual until the pet gets recovered. Apart from this, emotional distress to the owner, value of pet if it gets killed should be recovered and the punitive action against the killer should be initiated.
