  • After California was established as a state in 1850 , the California Land Act of 1851 was passed following the passing of the treaty of Guadalupe Hidalgo in 1848.
  • The treaty of Guadalupe Hidalgo protected the land rights of the Mexican people and gave full property rights to Mexican and Hispanic citizens.
  • But, the California Land Act confirmed the set up of a three member Public Land commission, which would validate the land grants to these Mexican and Hispanic citizens.
  • Thus, prior landowners would have to prove their validity of property and land, which they are holding, thus violating the treaty of 1848
