  • Manslaughter and murder are both unlawful killings of an individual,but manslaughter is still considered to be lesser offense than murder.Murder and manslaughter differ in terms of the intention which caused the death.
  • Murder is considered to be unlawful killing based on malice which aforethought which means that the person had the intention to kill the person,whereas Manslaughter though unlawful,doesnt have malice aforethought,there is no pre-planned intention to kill.
  • Involuntary manslaughter involves unintentional killing by the perpetrator,who accidently kills someone while indulging in some non-inherently dangerous felony.It can happen in many scenarios which could involve illegal or negligent behaviour that causes death.For example,a restaurant owner serves stale food to the customers,and they might die due to food poisioning,a doctor blindly administers wrong medication to the patient who suffers death etc.All these situations could be termed as involuntary,depending upon the facts surrounding the death.
  • A charge of involuntary manslaughter could be considered as less of an offense along with charges of murder.The jury would see the circumstances and the intention of the guilty,and if a pre-planned intention is not found and it is proven,that the death happened due to negligent behaviour,then homicide charges could be dropped with lesser punishment for only negligent behaviour.
  • When the person kills without any intention or conscious disregard for human life,then it becomes involuntary and less of an offense than a pre-planned murder.If for instance,the stale food caused a customer's death due to negligent behaviour,but the death happened naturally due to food poisoning,then it is involuntary manslaughter and the guilty would be charged for only selling stale food in their restaurant,shutting down their business, and not for murder,making it less of an offense.
