When we consider an independent contractor and an employee, the contract that is being handed to us by the company would be able to provide the necessary oversight as to what our role would be in the company as well as the structure and function of our process. What this means is that the company would have explicit bylaws and specific considerations when they hire a subcontractor and different clauses when they hire a regular employee, due to the fact that they need to safeguard their interests when there is a need for considerations in legal matters. Our contract would tell us about the specificity of our role as well as if the company is hiring us as a regular employee or as a subcontractor. The contract would also have the employment contract where the exact cycle or term of the contract would also be mentioned, also there would be a clause for consideration when the subcontractor commits any unethical processes or their actions result in any criminal proceeding, the company would not be held liable for their actions.
