Ans: Employers are in a tough spot—on the one hand, if they do not review applicants’publicly available social media, they expose the organization to workplace risks and negligent hiring. On the other hand, if they conduct the screening internally, they are exposed to a lot of information not legally allowable for hiring such as religion, sexuality orientation, and health status that may lead to a discrimination lawsuit. To explain further, there are two competing legal concerns in reviewing information about candidates for hire: discrimination and negligent hiring. If employers do not review available information about applicants, they expose the organization to the risks associated with possibly hiring an unacceptable applicant or even a negligent hiring lawsuit. However, if they use social media to learn more about applicants, they run the risk of being exposed to personally sensitive information that could lead to a discrimination lawsuit.
