Research a healthcare lawsuit. You will need to write a 1-2 page paper and include the following information: Give all details of the case: Plaintiff, Defendant, Crime/Tort/Claim of Negligence, Outcome, Any other pertinent information. Do you feel that the plaintiff presented a claim/crime worth pursuing? Do you feel that the courts came to the correct conclusion/outcome and punishment? Why or why not? Make sure to site your sources.

Medical malpractice is the best example of a breach of contract between the physician and the patient. Medical malpractice is the negligence of the physician in treatments that causes injury or even the reason for the death of the patient. Here, in this case, the patient or his/her relatives must prove that injury is due to the physician's negligence. Various cases of malpractices are reported from all over the world and finally taken those breaches to the court.

We will take a case from the United States of America as an example. Medical malpractice remains a major cause of injury and death in the United States. In 2007, the television host Ed McMahon suffered a fracture on his neck followed by a fall at his Los Angels home.  Next day, he visited Cedars-Sinai Medical Center for treatment but the physician failed to detect the fracture and discharged him without investigating the matter further. Later the problem was found by the hospital and followed by two spine operations to treat the damage. But he filed a malpractice suit against the hospital and orthopaedic surgeon for not identifying his neck fracture. He also argued that the two spine operations were not gone well, causing him great pain and discomfort for months. Later the file is closed by settling the Ed McMahon with an undisclosed amount paid by the medical centre.

I feel it was worth pursuing against the medical centre considering the pain and discomfort he underwent simply because of the negligence of the physician. The settling of the case with the deserved compensation was the right decision of the court because of the unwanted expenses occurred due to the two spine operations of the client.
