  1. Zaidun entered into a contract with Alang who has received a contract with the government for the construction of a hospital. Zaidun bought raw materials and delivered them to the construction site. Alang contract was cancelled by the government. When Zaidun wanted to sell the raw materials, it was discovered that Alang has sold them to Kumar.

Advise Zaidun and give reasons.

  • Zaidun has all rights to file suit against Alang.
  • This is basically Sale of goods without the knowledge of the owner.
  • The general rule where goods are sold by a non-owner is that the eventual purchaser does not gain good title.
  • Person who does not have good title to goods cannot pass on good title - the original owner is protected.
