Introduction:

Adams Memorial hospital is an Acute care general hospital in Adams county, the only hospital in mountains region popular with retirees and vacationers. Dr. Michael Henry is a skilled surgeon who is highly trained from prestigious institution, holding a license from State Medical Licensing Board as a sole practitioner in Adams County who had applied to AMH for medical staff membership and Clinical privilege and it was approved

Summary of the case:

Dr. Henry was always been unsatisfied about the level of care practiced by doctors, nurses and technicians working at AMH and also had given written complaint to Chief of Surgery about the equipment, procedure and performance of nurses and technicians which don't meet his unrealistic standards. Dr. Henry is a perfectionist with anger issues leading to scolding at nurses and technicians particularly nurse Ross who is a B.Sc degree holder with 37 years of experience with whom he has given written complaint that he won't be able to work with her. Inspite of not assigning nurse Ross with Dr. Henry he continues to show rage to nurses and technicians. A written warning is being intimated to Dr Henry but he does not budge to change. Hence, the medical staff of AMH notified Dr.Henry about proceeding in accordance with bylaws to revoke clinical privilege and staff membership due to disruptive behaviour.

Argument of Dr. Henry:

Dr. Henry claims to be the best doctor in AMH and these proceeding by staff of AMH is a conspiracy against him to avoid competition among doctors and to have their Monopoly. He claims to strive always to improve the quality of care provided my AMH and defies that his disruptive behaviour hasn't causes any harm to patient.

Counter argument by Director of Nursing:

Dr. Henry has disruptive behaviour due to which the staff and technician bare scared to voice their opinion Incase of a possible error . Hid refusal to work with nurse Ross has led to problems in staff scheduling. Due to all these reasons, there is a threat to patient safety.

Counter argument by Chief of Surgery:

Chief of Surgery agrees that Dr.henry has skills but the basic principles of respect and dignity is not followed which can lead to threat to patient safety Indirectly.

Issues with corresponding legal reference:

According to Code of Medical Ethics, like pgysiicians, nurses also hold a primary ethical obligation to promote patients wellbeing. Nurses training, expertise and scope compliments physicians professional commitment and expertise. Relationship of doctors with nurses should be mutual respect and trust. As per Federation of State Medical Board, disciplinary actions can be taken against a physician Incase of an unprofessional behavior which is clearly demonstrated by superiority feeling of being the best and abusive, disrespectful behaviour with co-workers.
