Compliance Officer : Compliance officer is the person who deals with the safety concerns of both employees and company following legal polices in terms of Law. Every organization will have a compliance officer to safe guard health information of a patient.

Compliance Officer in health care system should have information on HIPAA guidelines I.e. Health Insurance Portability and Accountability Act which deals with patient sensitive information and works on safeguarding patient privacy policy.

1. Q. How far it is necessary to appoint a compliance officer?

Ans: He/ She stated that it is necessary to appoint a compliance officer by any company that deals with Protected Health Information (PHI) to make the place secured.

2.Q. What is HIPAA and who will be part of this?

Answ: He/She answered this as HIPAA is Health Insurance Portability and Accountability Act.

Covered entitities I.e. all the patients, hospitals and Business associates who work on Patient Health Information are part of it and responsible to safe guard PHI.

1. Q. What are your roles and responsibilities as compliance officer?

He/ She answered as

  • As a Compliance Officer I must conduct HIPAA training sessions to all the associates of my company.
  • Create certain company policies according to HIPAA guidelines and make sure every one follow.
  • I must respond to the situations of breach , verify and work for the safety of both covered entities and Business associates.
  • All office premises should indicate that we are under strict surveillance , by pasting safety measures with indications.

2.Q. What is the process of a patient to file a complaint?

Answ: He/She answered that, If the patient is sure about the breach taken place they can immediately inform to the Office of Civil Rights through help portal numbers and also can mail OCR.

3.Q.How do you deal with civil vs criminal complaints?

Answ : I am personally as a compliance officer who is aware of both civil and criminal issues , In case of Civil will interview the concerned person and will take necessary actions if breach proved to be happened such as terminating the employee from work place.

In case of criminal it's my responsibility to deal with the facts of the scenario and hand over them to the police.

4. Q. What makes internal compliance to move to law enforcement, CMS ?

Answ: Answered as Internal investigation is the review of facts in case of any compliant received. This can be moved further to law if provider cannot pay to the loss happened, frequency of the issue happened whether it's first time or multiple things, nature and the services of that particular provider etc depends.

5.Q. What are the most important common risk management issues for this organization?

Answered as common risk management issues are

  • Safeguarding PHI can be done through locking systems,providing privacy through passwords etc
  • Access management issues, limited access to limited work
  • Mobile access issues, ID cards and tailgating
  • Printing Patient Health Information and discarding them in office premises etc.

6.Q. What type of accreditation issues do you work on?

Answ: I can deal with Joint commission services.
