In order to understand what a premium subsidy, you must first understand what a subsidy is. According to BCBSM.com, “a subsidy is financial assistance that helps you pay for something. It’s not a loan; you don’t pay it back.” Premium subsidy is used in the Affordable Care Act (ACA) to ensure that Americans who are in incomes between 100% to 400% of the federal poverty level have health insurance available to them. There is also a cost sharing reduction for those with incomes between 100% to 250% of the federal poverty level.

Employers are also required to provide health insurance to their employees. For an employer exempt from required to provide insurance, they must have 49 or less employees. If an employee, who is working for an employer with 50 or more employees, is receiving a Marketplace premium, the employer is required to pay an employer shared responsibility payment.

Problems began to arrive when the Internal Revenue Service (IRS) got involved. The IRS believed that purchasing premium subsidy through any Marketplace guarantees tax credit. Lawsuits began to rise in the federal courts due to the Marketplace being determined by the state not federally. Due to the wording in the ACA, many were confused on the Marketplace subsidies and the authority of the IRS to grant premium subsidies to those who used the federal Marketplace.

This brought into play King v. Burwell. The King v Burwell was a decision made by the Supreme Court in 2015, interpreting provisions of the Patient Protection and Affordable Care Act. The supreme court ruled in favor of the United States government and allowed Americans who purchased healthcare plans through the Federal Marketplace to continue to receive premium subsidies.

Answer: To lower the burden of cost on the people the Affordable Care Act includes government subsidies.This help people to pay their health insurance costs in the form of premiums. This subsidy makes health insurance affordable for most of the people. It also focuses on preventive care.

When insurance rates will be less then their will be more people who will get insured which can decrease the rate of people not getting proper treatment. Because of the high rates and cost of the health insurance people were unable to avail proper treatment facilities but providing subsidies will affect the people getting insured. The problem arises in the The IRS believed that purchasing premium subsidy through any Marketplace guarantees tax credit . Marketplace subsidies and the authority of the IRS to grant premium subsidies to those who used the federal Marketplace causes confusion.
