The judiciary department, on may 28 ,1788 the Federalist No 78 was successfully published and by the month of june14 that also in the same year it was appeared in a newspaper for the first time.

This theory was mainly proposed inorder to justify the structure of the judiciary which was mainly proposed under the proposed constitution of United State.The anti - federalists over the scope and the power of federal judiciary where mainly comprised unelected as well as the politically insulated judges can be appointed for life these all particular things where also mentioned in this theory. Mainly the federalist no 78 discuss about the power of judicial review and it mainly says that the federal judiciary has all the power inorder to determine whether the statues are constitutional or not .This is the theory in which publius mentioned about how to ought to respond in a state of emergency.
