I think that every emergency department who gets a suicidal patient should be held on a 24-hour psychological evaluation to make sure they don't harm their self or someone else from not getting proper treatment for whatever is causing the problem. Thus we can say surely that the emergency department has the liability for discharging a suicidal patient without further treatment but in the case instead of complete discharge, the patient is transferred to another department for his misbehavior there also the man is on the suicide watch.
2. Does the psychologist have liability for releasing the patient from suicide watch after a five-minute consult?
Yes. I believe that if the jail knew that he had already tried to commit suicide that the trained psychologist should have considered it all and knew from his training that he was a risk to himself and should be kept on suicide watch until further evaluation.
3. The psychologist is an "independent contractor" of the jail. Is the county liable for his actions?
We said yes. The jail is the one who chooses the psychologist to come in and evaluate the inmates and they should have made sure that he could do his job to the best ability to avoid problems with suicidal inmates who need proper care from the psychologist and not someone who is just going to release them after 5 minutes of talking.
