Answer #1

Negotiation is an art of talking on the terms and conditions or a discussion between two parties where the terms of employment or any issue is discussed and talked upon and final decision is taken after negotiating.

It is very important for both the parties to be flexible while doing negotiation as when the mindset of parties is flexible, they can easily win the argument and negotiation by bringing small changes in the terms and clauses. With flexible approach, the win- win situation can be easily achieved by the [parties without any loss to any of the parties. For example: in an organization if the employees are demanding an inclusion of extra 30 minutes in the lunch break, then while negotiating the managers if flexible can accept on this demand and in return increase the number of working hours by 30 minutes, in order to save the productivity being harmed. This is being flexible while negotiating where both the parties are in win- win situation and none loses.

On the other hand, the rigidity while negotiating will lead the negotiation process into a conflicting situation and the terms and conditions of none of the parties will be listened to and fulfilled. This might further result into the involvement of third party to resolve the conflicts. Hence the settlement will not be met fully. For example: in the same example stated above if the manager is rigid and does not permit the 30 minutes break being asked for, then this will create conflicts between the employees and employers and might lead to stoppage of work till the demands are not met.

Hence it can be said that a good negotiator is someone who listens to the terms and conditions of other party and being flexible tries to accept them by creating a win- win situation for both the parties, and not just arguing and being rigid on his own terms.
