Answer #1

The Difference between performance-based & prescriptive laws in occupational health & safety can best be explained with key arguments for & against these two forms of legislation as below stated by Health & safety authority :

  1. At first there as an argument on policy & commitment to the performance & perspective laws in the workplace should prepare an occupational health & safety policy program as part of the safety statement required by section 20 of the safety, health & welfare at work act 2005 which focuses on effective safety & health policies should set a clear direction for the organization to follow as law. This contributes to all aspects of business performance as part of continuous improvement. The for arguments for this can be cost-effective approaches to preserving & developing human & physical resources will reduce financial losses & liabilities & against argument is that there is a lot of time that takes in undergoing policy implementation which causes the safety & health of all people in the organization.
  2. The health management organization is held responsible to implement the policies & plans that are best suited in favor of all the people's performance & also the laws attached to it. The argument for here can be seen in the best possible ways to integrate the plans & actions for the safety & health policy to implement & against argument can be seen in coping the difference in the management that drives in proper decision making.

Following are some of the arguments based on both the performance-based & legal part to be considered:-

  • Employees must be provided with the instruction & training necessary to ensure thier safety & health with respect to the law on safety & health.
  • The health & safety needs an overview of the safety & health principles that are properly in detailed knowledge of the safety & health arrangements relevant to both performance-based & complied by law must be communicated well to each & every individual.

So, therefore, the performance-based occupational health & safety is where each & every employee & workers who work for the organization how the management is reviewing the performance on the safety & health issues is important to be addressed & that is compared with the legal considerations to which it is compliance with proper restrictions on certain health & safety measures to manage the performance review on it & as well take the necessary steps for proper management on it.
