                                                                     LABOR LAW

The basic aim of labor law is to remedy the "inequality of bargaining power" between employees and employers.They are over 180 federal employ laws which include the Fair Labor Standards Act (FLSA) of 1938,the Family and Medical Leave Act (FMLA) of 1993,the employment Retirement income Security Act of 1974,the Occupational Safety and Health act of 1970,the Equal Pay (EPA) Act of 1963.

  • Federal,State and local law sets minimum employment terms and conditions under Fair Labor Standards Act (FLSA).
  • To get better terms and to increase their bargaining power,employees organized labor unions for collective bargaining.
  • Employer should employ certain number of employees in order to covered by Federal Employment Law.Smaller number of employees cover under state and local laws.
  • Employer or employee can terminate at-will agreement with or without any prior notice or with with or with out any reason as long as Federal,State and local laws are not violated.
  • There is no need for written contracts in Federal employment Law.
  • Employers are required to pay the minimum wage and overtime if employee worked more than 40 hours per week.
  • According to Civil Rights act of 1964, all the employing entities labor unions should treat employees equally,without discrimination based on "race,color,religion,sex,national origin.
  • According to FMLA employees are eligible to take up to 12 weeks of unpaid,job protected leave per year.
  • There is no need of termination notice should be given by employer according to at-will,but employer must give termination notice if employee is covered under WARN.
  • The Occupational Safety and Health Administration (OSHA),provides work place free from serious hazards to employees.
