The National Labor Relations Act (Wagner Act) plays a vital role in union organizing. It provides rights for employees to organize unions and also provides guidelines in establishing unions for the organization. It provides a framework to establish management-employee relations. The Act protected the workers from discrimination of any form and also guided employees for collective bargaining with employers. The Act also prohibited employers to assume unfair labor practices such as firing, setting up unions and discriminating union employees. Thus, it is pertinent to say that the Wagner Act protected the workers and provided them with rights to form unions.

The Wagner Act allowed employees to form unions to prevent unethical and unfair trade practices by employers, encourage collective bargaining with employees and discriminate employees who are part of the union or file under the Wagner Act. To monitor the union-management relation, the Wagner Act created the NLRB (National Labor Relations Board) which has the primary purpose to oversee the employer and union relationship. This NLRB provides a framework for the legal structure for the formation of unions. NLRB designates legalities for decertifying unions and also for conducting elections in the union.

NLRB investigates any charges that the employee or the union representative has raised to investigate if the employer or the employee has violated the rights under Wagner Act. Wagner Act encourages negotiation and helps to arrive at settlement of disputes. NLRB is usually involved when the case have not been resolved through mediation.
