so in a study an a foreign buyer who sold pillows shaped like stuffed animal. which can also be used as pillows. It turns out, this difference is - basically there is a tariff on pillows but not on stuffed animals.

this feels absurd and legalistic in the way that a lot of 21st century stories feel absurd and legalistic but it turns out , this kind of thing goes back centuries.

In 19th centuries , the U.S. supreme court faced a similarly absurd question: are tomatoes vegetables or fruits?

at that time the port authority of New York classified tomatoes as vegetables, which were subject to a 10 % import tax.

a fruit foreign buyer argued that tomatoes were fruits, and fruits were not taxed.

in the case, a viewer read from dictionaries, and definitions for fruit and vegetable . were read in court. also definitions of tomato, pea, eggplant, cucumber, squash, and pepper.

in the supreme court the decision, the justices told the differences between science and everyday life. The justices admitted that botanically speaking, tomatoes were technically fall under fruits. But in everyday life, they decided, vegetables were things that usually served at dinner in dinner , with dinner ,or after the fish, soup ,meats etc. and not like fruits generally. as dessert.

So, at last the court ruled, tomatoes counted as vegetables and the foreign buyer had to keep paying the tariff for it.
