Many believe that there are too many lawsuits in the United States. Do you agree or disagree? Why? Discuss who should accept more blame for the problem, lawyers or individuals who go to court. Do you think there is anything that would mitigate the problem, or will there always be a large numbers of lawsuits?

Yes, I agree that there are too many lawsuits in the United States. This is based on an estimate of over 40 million lawsuits that are being filed on an annual basis. This number is high compared to the population of the country. Moreover, according to the Federal Judicial Caseload Statistics, there has been an upward trend, when it comes to the cases filed in the courts from 0.99 in 2006 to 9.88 in 2016. This is a huge rise within a short span of 10 years. In addition, the number of lawyers registered in the country is high exceeding over 1 million. The reason is clear USA is a nation where lawsuits are prominently on the rise making the profession profitable. The reason for this increase can be attributed to the permissive and open claim system of jurisdiction. This deals with four aspects that are needed for anyone to sue or be sued they are a standing where someone has been aggrieved, jurisdiction, facts related to the case, and damages then any claim is open to proceed to the courts.

I believe that the individuals who go to court should accept more blame for the increase in the number of lawsuits. The lawyers are not to blame because they do not go out to seek clients to represent but it is vice versa. Individuals have a high personal need to exercise their freedom and rights which makes them neglect alternative ways of solving their disputes in preference of the courts. In addition, the continuous focus on individual rather than group rights increases the caseload. This is because individuals do not focus on the wider impact of their actions on others but in the narrow perspective which is selfishly geared towards what they stand to gain. This makes individuals go out to seek lawyers to represent them in minute cases that could have easily been handled outside courts.
