How would you explain the concept of confidentiality to a client?
Ans) Confidentiality:
Information about a patient or client that is harmful, shameful, or embarrassing
Confidentiality includes:
-info that is furnished by patient directly
-Info that comes to you in writing or through electronic data
-Info that comes from a 3rd party
The patient is the best judge.
The right to privacy gives- legal standing to this ethical principle
-The most longstanding ethical dictum in health care codes of ethics.
Treat caution as a virtue
Right to Privacy-
not incorrect because the right to privacy means that there are
aspects of a persons being into which no one else should
intrude
Patients share private info do so
(and thus relinquish their privacy) because they have a reasonable
expectation that sensitive info will be shared with certain people
to further their welfare - but that it will not be shared with
others.
- Confidentiality is the practice of keeping harmful, shameful, or embarrassing pt info within proper bounds
- The immediate aims of confidentiality are to:
1)Facilitate the sharing of information with the goal of helping
the patient
2) exclude unauthorized people from such information
3) discern need-to-know information from mere interest when
deciding what to share
It is NOT considered a breach of confidentiality if you
share "secret" info with other health professionals involved in the
pt's care as long as the info has relevance to their role in the
case
Do others "need to know" in order to provide the most "caring response" to the patient
AOTA Code of Ethics:
Principle 3.G.
- Ensure that confidentiality and the right to privacy are
respected and maintained regarding all information obtained about
recipients of service, students, research participants, colleagues,
or employees.
Principle 3.H.
- Maintain the confidentiality of all verbal, written, electronic,
augmentative, and non- verbal communications, including compliance
with HIPAA regulations.
- Client confidentiality is the principle that an institution or individual should not reveal information about their clients to a third party without the consent of the client or a clear legal reason. This concept is commonly provided for in law in most countries.
