The discriminatory act is the; singling out; or make a distinction at work, or at any other place such as the public place. It is a violation of the Federal legislation, like the Civil Rights Act of 1964 and the Americans with Disabilities Act (ADA) or the Federal court decisions, like the U.S. Supreme Court case Brown v. Board of Education for education.

The manager/supervisor can prevent discrimination from happening by responding to discrimination and having a transparent bias-free policy when it comes to hiring and promotion.

Things the employee can do to protect themselves is form groups, raise concern in the organization when discrimination happens and make use of the media.
