B. disparate impact

Title VII of the civils rights act of 1964 prohibit discriminations against people on a number of grounds. These include race, caste, sex, etc. Employment practices that have negative impact on the protected classes of individuals are said to have disparate impact and are prohibited under law. The US supreme court will addressing it said that the burden of proof should be transferred to the employer if the employee or job applicant who belongs to the protected class proves that the particular employee caused disparate impact to the protected class. It was later amended that once the employee proved disparate impact, the employer must prove that the practice is job related.
