My answer

1) A consent from the patient is not required in an emergency situations. If a child is in an emergency, professionals can treat the child despite of parent’s objections. In some cases unliterate parents do not know the seriousness of child’s diseases. They may opt to give some medication to relieve the child’s chest pain, in case where the child need an emergency surgery. Some parents are surgery phobic, and will deny to do. Inorder to save patients life the physician can go for surgery without consent.

2) A capacity is a person’s ability to give informed consent to a particular treatment decision in a particular time. According to the mental health act 2014 all people recieving mental health treatment have capacity to make decision on their treatment.

A person lack capacity when:

If he or she is detained or sectioned under some section of mental health act.

If he or she does not have the capacity to decide whether to have treatment.

If it is emergency life saving treatment and patient or family cannot give consent.

Answer: Informed consent contains all the information regarding the treatment, consequences which the patient should understand before any kind of treatment. The informed consent usually obtained to provide full knowledge to the patient. This should be written in tha language that can be easily understood by the patients. Normally it is important to provide the informed consent but in the case where the patient is unable to sign the form, the informed consent is pretty assumed.

A consent from the patient is not required in an emergency situations. If a child is in an emergency, professionals can treat the child despite of parent’s objections. In some cases illiterate parents do not know the seriousness of child’s diseases. They may opt to give some medication to relieve the child’s chest pain, in case where the child need an emergency surgery.

In the three cases where the informed consent is not necessary are:

  • TThe patient is incapable to sign the form as well as understand the information written.
  • In the case where life threatening emergencies.
  • Waived consent.

A capacity is a person’s ability to give informed consent to a particular treatment decision in a particular time. According to the mental health act 2014 all people recieving mental health treatment have capacity to make decision on their treatment. Ability to understand the major concept behind the treatment as well as co- operating the healthcare professionals can reduce the disparities. This is also improves treatment satisfaction level as the patient itself knows about the consequences if occured any.
