* privacy is a moral right in true senses. it should be respected and aided by the healthcare facilitators. there are many medical related practices, procedures and solutions which make it a subject of debate whether privacy should be granted or not. but time n space has always preferred and selected an individuals choice over what society's empty speculations desires. hence, issues like abortion, surrogacy, birth control, taking ones own life (euthanasia) or refusal of medical care are examples to this. A person’s interest in following his own convictions is so central a part of the more general right to make ‘intimate and personal choices’ for himself that a failure to protect that particular interest would undermine the general right altogether.
the society imposes major privacy and private choice related legal obligations on its members. breaching medical confidentiality or disclosing a private medical fact is a civil liability. the law imposes obligations to respect confidentiality, data security, secrecy and anonymity. the law binds the health care providers, insurers, health-data processors, health researchers, public health officials and government.

smoking how much ever and wheresoever is a persons own choice, even if it has many ill effects on the health of the person himself. but its a policy in some places across the world that one should not smoke in public places as passive smoking is equally harmful for the person who is not smoking but inhaling it.
Government can educate the public, require labeling of food, drugs, tobacco, and other hazardous products, and regulate advertising even if the public likes such stuff more (for example, restricting ads that target children). it can zone and plan authoritative steps to help individuals to make healthy choices (for example, reducing the concentration of fast food, firearm, liquor, or gambling outlets and investing in public transportation, parks, bicycle paths, and recreational facilities).
