Criminal Law:
What do you know about criminal law? Where did you learn this information? Are there topics associated with criminal law about which you wish to learn more?
answer-
I would not say that i know all about criminal law because this is the study which is very broad. I know that Criminal law is the study where laws are made to make sure criminals are prosecuted and penalties are imposed on criminals. It is a body of law which ensure criminal acts are prosecuted in courts and offenders are punished according to their criminal acts like theft, murder, assault, rape etc.
I also know know some of the main objectives of criminal law that are-
Retribution – Criminals ought to Be Punished in some way.
Deterrence – Individual deterrence is aimed toward the specific offender. The aim is to impose a sufficient penalty to discourage the offender from criminal behavior .
Incapacitation – Designed simply to keep criminals away from society so that the public is protected from their misconduct. This is often achieved through prison sentences today.
Rehabilitation – Aims at transforming an offender into a valuable member of society. Its primary goal is to prevent further offense by convincing the offender that their conduct was wrong.
Restoration – This is a victim-oriented theory of punishment. The goal is to repair, through state authority, any injury inflicted upon the victim by the offender .
i also have some ideas about element of crime which helps to make sure crime has been committed or not.Actus Reus means There must be an actual act committed (not just thought). second is Mens Rea means There must be criminal intent.Third is Concurrence means A criminal act and criminal intent must occur at the same time, with the intent coming before the crime.fourth is Causation means The criminal act must be directly to the actual harm it caused the victim and last is Harm means There must be harm actually inflicted to an individual, property, or society before a crime can be established.
I Learned this information from Class lectures, online library means internet and my class mates in discussions which i think great source to gather information on this topic.
