Describe the effect of employee rights legislation on human resource management practices.
There are a number of federal employment rules and laws which are subjected to the human resource management practices. Along with this, the HR department is also subjected to the reviews by a number of federal agencies. The major laws are mainly related to the gender, colors, religion, age, national origin, race, disability of the employee or the candidate applying for the job in the firm. The unjust discrimination of any candidate by the HR department of any organization can be determined with the help of disparate treatment (intentional discrimination) and adverse impact (unintentional discrimination), while quid pro quo and hostile work environment are the regulations which regulate the sexual harassment incidences in the organization
While performing the normal activities, HR department of any organization must have to ensure that no laws or rules related to the human resource practices are breached by it otherwise it can land the company in the different lawsuits which can be initiated by the candidate, current employee, and federal agencies or even by the NGOs. The human resource department must ensure that equal opportunity and fair treatment are provided to everyone who is applying for the job or currently working in the organization. No discrimination is made among the candidates or employees else the firm can be prosecuted under Civil Rights Act of 1964, Age Discrimination in Employment Act of 1967, Pregnancy Discrimination Act of 1978, Americans with Disabilities Act of 1990, Genetic Information Nondiscrimination Act of 2008.
The HR department has to ensure that equal and just compensation is paid to all the employees and if there is any kind of grievance, it must be cleared to the affected individuals. Any violation can result in the action against the company as per the Equal Pay Act of 1963
Thus while performing different activities in the HR department, it is important to the organization to adhere to different laws and regulation in order to avoid legal actions.
